Terms of Services

These are the terms of service for the FTXCreditor Now platform. Please review them carefully before using the service.

1. I am the duly authorized user of, and exclusive owner of the proceeds in, the FTX account and claim I am seeking to transfer.
2. I am 18 years of age or older.
3. I have not sold, transferred, or otherwise encumbered my FTX claim to any other person or entity.
4. I agree to provide FTXCreditor, and authorize them to use, my User Credentials, Security Passwords (including One-Time Passwords), and any Multi-Factor Authentication codes for my FTX account and FTX claims account.
5. I understand and agree that I am providing such access and information to FTXCreditor to assist FTXCreditor in evaluating and perfecting ownership of the claim(s) I am seeking to transfer to them, as well as for FTXCreditor to conduct appropriate diligence under applicable law, including anti-money laundering and sanctions laws and regulations.
6. I authorize and permit FTXCreditor to access my FTX account and FTX claims account and obtain information from those accounts on my behalf.
7. I am knowingly and voluntarily providing information to FTXCreditor in connection with my intent to transfer my FTX claim(s) to them.
8. I understand that FTXCreditor monitors its interactions with me – including through audio recording, video recording, virtual screen-sharing sessions, screenshots, web beacons, and cookies – and I consent to all such monitoring.
9. I consent to FTXCreditor downloading account and claims information related to the FTX claim(s) I am seeking to transfer to FTXCreditor.
10. I consent to providing the following information to FTXCreditor: name, address, date of birth, government-issued identification information, and FTX account and FTX claims information (including balances, transaction history and details, and associated cryptocurrency wallet addresses).
11. I consent to FTXCreditor preserving and maintaining all information, documentation, recordings, screen-sharing sessions, web beacons, cookies, and screenshots for as long as the information is required to fulfill FTXCreditor’s legitimate business needs, for the purposes for which FTXCreditor collects such information, and/or for as long as is required by applicable law.
12. I agree to cooperate with FTXCreditor, and provide information requested by them, to assist FTXCreditor in perfecting ownership of the claim(s) I am transferring to it, as well as to defend against any claim against it relating to the transfer of such claim(s).
